DMCA Policy

Safe harbor notice

pail complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). We respond to valid notices of alleged copyright infringement and will remove or disable access to infringing content in accordance with this policy.

Submitting a takedown notice

To submit a DMCA takedown notice, send a written communication to our designated agent containing all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work(s) you claim have been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
  3. Identification of the material claimed to be infringing — specifically, the full URL(s) of the pail artifact(s) you believe infringe your copyright.
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Response timeline

We will review each notice and, if it is complete and facially valid, we will remove or disable access to the identified content within 5 business days. We will notify the uploader that their content has been removed and provide them with a copy of the notice.

Counter-notice

If you believe that your content was removed by mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court in San Francisco, California, and that you will accept service of process from the person who provided the original notice.

Upon receipt of a valid counter-notice, we will forward it to the original complainant and, absent a court order, restore the removed content within 10–14 business days.

Repeat infringers

In accordance with the DMCA and our Terms of Service, we will terminate the accounts of users who are repeat infringers.

Misuse of DMCA notices

Submitting a false or misleading DMCA notice is a violation of our Terms of Service and may expose the submitter to civil liability under 17 U.S.C. § 512(f). We reserve the right to seek damages from any person who knowingly misrepresents that material or activity is infringing.
