Terms of Service

Effective date: April 30, 2026

1. Acceptance

By creating an account or using pail (the "Service") you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users including free, Pro, and Team plan subscribers.

2. Service description

pail provides a hosted set of MCP-native tools that let coding agents upload files, post questions, render diagrams, track progress, and perform similar artifact-handling tasks. The output of each tool is a URL that resolves to a rendered page.

pail is a developer tool. It is not intended for end-user-generated content at scale, social networking, file backup, or any purpose other than agent-assisted development workflows.

3. No service-level agreement

The Service is provided on a best-effort basis. We do not offer any uptime guarantee or SLA. Scheduled and unscheduled maintenance may cause temporary unavailability. We will make reasonable efforts to provide advance notice of planned downtime.

4. Acceptable use

You may not use the Service to upload, store, transmit, or process any content that:

  • Contains malware, ransomware, spyware, trojans, or any other malicious code.
  • Constitutes child sexual abuse material (CSAM) or any material that sexually exploits minors.
  • Violates any applicable law or regulation, including export control and sanctions laws.
  • Infringes the intellectual property rights of any third party.
  • Is designed to circumvent the Service's rate limits, authentication mechanisms, or security controls.
  • Is intended to harass, threaten, or harm any individual or group.

Accounts found to be in violation of this section will be terminated immediately and without refund. We reserve the right to report violations to law enforcement where required by law.

5. Executable code and free tier restrictions

On the free tier, you may not upload executable binaries, compiled code, or installer packages as the primary payload of a share. Sharing source code files is permitted on all tiers. Paid tiers may upload executable artifacts subject to the acceptable use policy above.

6. Artifact ephemerality and revocation

Artifacts (shares, questions, reviews, and all other pail objects) are ephemeral by design. They may expire based on your plan's TTL, your explicit revocation, or administrative action. We reserve the right to revoke any artifact at any time without prior notice if it violates these Terms, is reported under our DMCA policy, or is otherwise determined to be harmful.

Do not rely on pail for permanent storage. We are not responsible for data loss resulting from TTL expiry, account deletion, or service disruptions.

7. Account termination

We may suspend or terminate your account at our discretion if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the integrity of the Service. Upon termination for cause, no refund will be issued for prepaid subscription periods.

You may delete your account at any time from the account settings page. Account deletion initiates a 30-day data-retention window after which all data is permanently deleted.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAIL OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via the blog at /blog and, where feasible, by email. Continued use of the Service after changes constitute acceptance of the updated Terms.
